These Terms of Service (“Terms”) govern your access to and use of the Flee mobile application, the website at fleeapp.ca, and related services (collectively, the “App” or “Service”) provided by Flee (“Flee,” “we,” “us,” or “our”).
By downloading, installing, accessing, joining our waitlist, or using the App, you acknowledge that you have read, understood, and agree to be legally bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must stop using the App and delete it from your device.
Supplemental terms or documents posted on the App from time to time are incorporated by reference. We may change these Terms at any time; we will indicate the “Last updated” date above, and your continued use of the App after changes are posted means you accept the revised Terms. We recommend you keep a copy for your records.
Important disclaimers
Faith-based, non-medical, and educational disclaimer
Flee is a faith-based self-help and habit-tracking companion designed to support people seeking freedom from pornography and related struggles, grounded in Christian encouragement and accountability.
The App is not a medical service, is not therapy or counseling, is not a medical device, and does not diagnose, treat, cure, or prevent any condition. Nothing in the App constitutes medical, psychological, or professional pastoral advice, and no doctor-patient, therapist-client, counselor, or clergy relationship is created by use of the App. The App offers spiritual encouragement and self-directed tools, not professional care.
If you are experiencing mental health distress, addiction concerns, or a crisis, you should consult a qualified healthcare or mental health professional immediately. The App is not a substitute for professional treatment, and in an emergency you should contact local emergency services.
Behavioral health and addiction risk disclaimer
Flee addresses topics related to pornography use, compulsive behaviors, sexual integrity, and habit change. These topics may involve sensitive personal, emotional, spiritual, or psychological issues. You acknowledge and agree to the following:
- Individual results vary. Behavioral change, habit formation, and recovery are highly individual processes. The App does not guarantee any particular result, including abstinence, relapse prevention, emotional improvement, or spiritual outcome.
- Risk of emotional distress. Tracking behavior, viewing Days Free or heart-posture data, logging a Breach or Relapse, writing a Surrender, or taking part in Fellowship may produce emotional reactions including stress, anxiety, guilt, shame, frustration, or disappointment. Such reactions are a normal possibility when engaging with habit-tracking and accountability tools.
- Not a clinical program. Flee does not provide addiction treatment, behavioral therapy, or psychological counseling, and is not intended to replace professional care.
- User responsibility for decisions. You remain solely responsible for your own decisions, actions, and behavioral choices. Decisions about recovery, abstinence strategies, mental health, or lifestyle should be made independently or with qualified professionals.
- No monitoring of behavior. Except for activity you choose to record in the App or share through Fellowship or accountability features, Flee does not monitor or verify your behavior outside the App and cannot confirm whether any goal is met.
- Community content is not professional advice. Content shared by other members in Fellowship or other community features does not constitute professional, medical, or pastoral advice and may not be accurate, safe, or appropriate.
To the maximum extent permitted by law, you agree that Flee shall not be liable for claims arising from relapse or inability to change a habit, emotional or spiritual distress related to tracking, mental health outcomes associated with use of the App, interactions with other members, or reliance on App insights, metrics, or tracking tools. If you experience severe distress or addiction symptoms, seek help from a qualified professional.
1. Our services and scope
The App is not tailored to comply with industry-specific regulations such as HIPAA, and is not intended for any use that would be contrary to law in your jurisdiction. Those who access the App from other locations do so on their own initiative and are responsible for compliance with local law. The App is intended for personal, non-commercial use.
2. Eligibility
Because the App addresses topics relating to sexual behavior, you must be at least 16 years old, or the age of digital consent in your jurisdiction, to use the App. If you are under 18, you represent that a parent or guardian has reviewed and agreed to these Terms and that your use is supervised where required by law. Flee may suspend or terminate accounts where age requirements are not met.
3. User representations
By using the App, you represent and warrant that: (1) you have the legal capacity to agree to these Terms and will comply with them; (2) you are not a minor in your jurisdiction, or if a minor, you have parental permission and supervision; (3) you will not access the App through automated or non-human means; (4) you will not use the App for any illegal or unauthorized purpose; and (5) your use will not violate any applicable law. If any information you provide is untrue or incomplete, we may suspend or terminate your account.
4. Account registration and security
Some features require an account. You agree to provide accurate information, maintain the security of your credentials, and promptly notify us of any unauthorized access. You are responsible for activity that occurs under your account, and Flee is not responsible for losses caused by unauthorized access you could have prevented.
5. License to use the App
Subject to these Terms, Flee grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to use the App solely for your personal, non-commercial use. All rights not expressly granted are reserved by Flee.
6. Mobile application license (Apple and Google)
If you access the App through the Apple App Store or Google Play (each an “App Distributor”), you agree that:
- your license is limited to using the App on a device you own or control, in line with the App Distributor's usage rules;
- Flee, not the App Distributor, is responsible for any maintenance and support, and the App Distributor has no such obligation;
- if the App fails to conform to any applicable warranty, the App Distributor may refund the purchase price (if any), and to the maximum extent permitted by law has no other warranty obligation;
- you represent that you are not located in an embargoed or restricted country and are not on any government prohibited-parties list;
- you will comply with applicable third-party terms when using the App; and
- the App Distributors are third-party beneficiaries of these Terms and may enforce them against you.
7. Intellectual property ownership
The App and all related technology, including the software, algorithms, databases, designs, graphics, text, branding, trademarks, logos, interface elements, and tracking and insight models, are and remain the exclusive property of Flee or its licensors, and are protected by applicable copyright, trademark, trade secret, and other intellectual property laws.
8. Intellectual property restrictions
You may not, directly or indirectly:
- copy, reproduce, modify, distribute, sell, license, or create derivative works of the App;
- reverse engineer, decompile, or disassemble any part of the App, or attempt to extract its source code, algorithms, or data models;
- scrape, harvest, or collect data from the App, or use bots, crawlers, or scraping tools;
- mirror or frame the App, or use it to build a competing product or service;
- probe, scan, or test the vulnerability of our systems, or bypass security protections or rate limits.
9. AI training and data extraction prohibition
You may not use the App, its content, data, functionality, or underlying technology to train, develop, fine-tune, or improve any artificial intelligence, machine learning, or large language model system without Flee's prior written consent. This includes scraping, extracting, or collecting App data for the purpose of training, validating, benchmarking, or developing any such model. Flee reserves all legal remedies for violations of this section.
10. Platform integrity and enforcement
Any unauthorized access to, use of, or interference with the App, its infrastructure, its data, or its underlying technology is prohibited. Where such conduct is identified or reasonably suspected, Flee may suspend or terminate access; block devices, accounts, IP addresses, or networks; preserve evidence; cooperate with law enforcement; and pursue civil claims. Unauthorized access to computer systems and interference with platform security may violate applicable laws and result in civil or criminal liability.
11. Your content and submissions
The App lets you create content such as progress logs, Relapse and Breach logs, Surrender prayers, journal notes, and Fellowship posts (“Your Content”). You retain ownership of Your Content. By submitting it through the App, you grant Flee a worldwide, non-exclusive, royalty-free license to store, process, display, and transmit it solely to operate, maintain, and improve the App. You represent that you have the right to submit Your Content and that it does not violate the rights of any third party.
Separately, if you send us feedback, suggestions, or ideas about the App (“Submissions”), you agree we may use and share that feedback for any purpose without obligation or compensation to you.
12. Prohibited conduct
You agree not to:
- violate any applicable law;
- harass, threaten, or abuse other members;
- upload or transmit illegal, harmful, or unlawful content;
- post explicit sexual material or sexually exploitative content;
- impersonate any person or entity, or use another member's account;
- use the App for spam, solicitation, or unauthorized commercial purposes;
- systematically retrieve data to build a collection or database, or use bots, scrapers, or other automated tools;
- interfere with, disrupt, or degrade the App or its services, or attempt to bypass security or moderation systems.
13. Fellowship and community content disclaimer
Content submitted by members reflects solely the views of those members. Flee does not endorse, verify, or assume responsibility for member-generated content, including the accuracy or reliability of any statement, advice, or recommendation, or for interactions that occur within Fellowship or other community features. Please use discretion and avoid sharing identifying or highly sensitive details with others.
14. Subscriptions and billing
Some features may require a paid subscription, which may be purchased through the Apple App Store, Google Play, or another authorized processor. Subscriptions automatically renew unless canceled, and you consent to recurring charges until you cancel. You may cancel at any time, effective at the end of the current paid term. Payment processing and billing are governed by the applicable platform, fees are non-refundable except where required by law, and Flee may change subscription pricing or terms with reasonable notice.
15. Beta features
Flee may release experimental or beta features. These may be unstable, may change or be discontinued at any time, and may contain errors. They are provided on an “as is” basis without warranties of any kind.
16. Third-party services
The App relies on and may integrate with third-party services such as hosting, database, and analytics providers. Flee is not responsible for third-party content, policies, or data practices, and your use of those services is governed by their terms. If you download the App from the Apple App Store, these Terms are between you and Flee, not Apple.
17. Services management
We reserve the right, but not the obligation, to monitor the App for violations of these Terms; take legal action against anyone who violates the law or these Terms; refuse, restrict, or disable any content in our discretion; remove content that is excessive or burdensome to our systems; and otherwise manage the App to protect our rights and ensure it functions properly.
18. Your data and backups
We maintain data you transmit to the App in order to provide the Service, and we perform routine backups. However, you are solely responsible for the content you create, and you agree that Flee has no liability to you for any loss or corruption of that data. We recommend you keep your own records of anything important to you.
19. Disclaimer of warranties
To the maximum extent permitted by law, the App and all related content, features, and services are provided “as is,” “as available,” and “with all faults.” Flee disclaims all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, and uninterrupted, secure, or error-free service.
20. Limitation of liability
To the maximum extent permitted by law, Flee shall not be liable for any indirect, incidental, consequential, special, or exemplary damages, including emotional or spiritual distress, addiction-related harms, loss of data, or loss of profits, arising out of or related to the App or these Terms. Flee's total cumulative liability for all claims related to the App shall not exceed the greater of one hundred dollars (USD 100) or the total amount you paid Flee in the twelve months preceding the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
21. Indemnification
You agree to indemnify, defend, and hold harmless Flee and its affiliates, officers, members, employees, and agents from any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to your use of the App, your violation of these Terms, any content you submit, or your violation of any law or the rights of any third party.
22. Dispute resolution
Most concerns can be resolved by contacting us first at graham@fleeapp.ca, and you agree to attempt to resolve any dispute informally before pursuing formal action. The specific binding-arbitration, class-action-waiver, venue, and procedural terms depend on your jurisdiction and the jurisdiction in which Flee operates and will be confirmed before public launch. Regardless of the mechanism adopted, the following will be excluded from any mandatory arbitration: disputes seeking to enforce or protect intellectual property rights; disputes alleging theft, piracy, invasion of privacy, or unauthorized use; and any claim for injunctive relief. Nothing in these Terms removes any right you cannot waive under the consumer-protection laws of your jurisdiction.
23. Termination
Flee may suspend, restrict, or terminate your access to the App at any time, with or without notice, if you violate these Terms, misuse the App, or engage in conduct that creates legal, security, or reputational risk. If your account is terminated, you may not create a new one under a different or borrowed name.
24. Modifications and interruptions
Flee may change, modify, or remove App content, features, or pricing at any time, with or without notice, subject to applicable law. We cannot guarantee the App will be available at all times and may experience hardware, software, or maintenance issues that cause interruptions, delays, or errors. You agree that Flee has no liability for any loss or inconvenience caused by your inability to access the App during any downtime or discontinuance.
25. Corrections
The App may contain typographical errors, inaccuracies, or omissions, including in descriptions, pricing, or availability. We reserve the right to correct any such errors and to update information at any time without prior notice.
26. Corporate transactions
If Flee undergoes a corporate transaction such as a merger, acquisition, financing, restructuring, or sale of assets, information associated with your account may be transferred to the successor entity, which will be required to handle personal information consistent with our Privacy Policy or to provide notice of any material changes as required by law.
27. Export compliance
You may not use, access, or export the App or related technology in violation of applicable export control laws, sanctions, or trade laws.
28. Electronic communications, transactions, and signatures
By using the App, joining our waitlist, sending us email, or completing forms, you consent to receive communications from us electronically, and you agree that all agreements, notices, and disclosures we provide electronically satisfy any legal requirement that they be in writing. You consent to the use of electronic signatures and records, to the extent permitted by applicable law.
29. Governing law
These Terms are governed by the laws of the jurisdiction in which Flee operates, without regard to conflict-of-laws principles, and subject to any mandatory consumer-protection laws of your place of residence. The specific governing jurisdiction will be confirmed before public launch.
30. Miscellaneous
These Terms, together with the Privacy Policy and any feature-specific terms, constitute the entire agreement between you and Flee. Our failure to enforce any right or provision is not a waiver of it. If any provision is held unlawful or unenforceable, it is severed and the remaining provisions stay in effect. We may assign our rights and obligations at any time. We are not liable for any delay or failure caused by events beyond our reasonable control. No joint venture, partnership, or employment relationship is created by these Terms, and they will not be construed against us for having drafted them.
